  6.    PLEASE READ THIS LICENSE AGREEMENT BEFORE LOADING THE PROGRAM INTO YOUR
  7.  COMPUTER. IF YOU DO NOT ACCEPT THE TERMS OF THIS AGREEMENT -  DO NOT LOAD THE

  11. Definitions
  12. The following definitions apply to the terms as they appear in this License:
  13. - "Atlant Software" means Atlant Software Company.
  14. - "The Program ("Program") means the computer programs and documentation
  15. included in this package of Actual Checkers / Atlant Software.
  16. - "Unregistered" means a version of the Program in which not all functionality
  17. is available
  18. - "Full Functionality Mode" means a version of The Program in which all
  19. functions operate with no time and capabilities limit.

  22. License Grant
  23.  
  24. - Atlant Software grants you a non-exclusive license to:
  25. - Load the Program into your computer's storage device from the media
  26. provided.
  27. - Obtain from Atlant Software or their agents serial numbers to enable the
  28. purchased portion of the Program to run in Full Functionality Mode.
  29. - Allow others to run Program in Unregistered Mode, unless or until requested
  30. by Atlant Software not to do so.
  31. - Obtain from Atlant Software free email support for program's lifetime
  32. period
  33.  
  34. - GRANT FOR UNLIMITED USE OF UN-REGISTERED VERSION. Atlant Software hereby
  35. grants you a non-exclusive license to use this Atlant Software in
  36. Unregistered mode free of charge in period of 18 days. You are not entitled to
  37. hard-copy documentation, support or telephone assistance.
  38.  
  39. You may not:
  40. - Remove or alter any of Atlant Software's copyright notices from any
  41. components of Program.
  42. - Sub license, rent or lease all or part of the Program.
  43. - Use the Program with the intent to violate any licensing agreements or
  44. contracts.
  45.  
  46. - Modify, adapt, translate, create derivative works, decompile, disassemble,
  47. or otherwise reverse engineer or attempt to reverse engineer or derive source
  48. code from all or any portion of the Program or anything incorporated therein
  49. or permit or encourage any third party to do so.

  51. Violation of the above-stated rules may result in temporary or permanent
  52. revocation of this license and cancellation of the registration codes in the
  53. purchased portion of the Program.

  55. Once serial numbers have been obtained from Atlant Software or their agents,
  56. the license to run the Program in Full Functionality Mode may be assigned to
  57. an individual *or* a computer, i.e., a single individual may use the Program
  58. in several locations, or several persons may sequentially run the Program on
  59. the same computer.
  60.  
  61. Distribution:
  62. Provided that you verify that you are distributing the Unregistered Shareware
  63. Version  you are hereby licensed to make as many copies of the Shareware
  64. version of this software and documentation as you wish; give exact copies of
  65. the original Shareware version to anyone; and distribute the Shareware version
  66. of the software and documentation in its unmodified form via electronic means.
  67. There is no charge for any of the above.
  68.  
  69. You are specifically prohibited from charging, or requesting donations, for
  70. any such copies, however made; and from distributing the software and/or
  71. documentation with other products (commercial or otherwise) without prior
  72. written permission, with one ex ception: Disk Vendors approved by the
  73. Association of Shareware Professionals are permitted to redistribute Actual
  74. Checkers v.1.0-R, subject to the conditions in this license, without specific
  75. written permission.

  77. Copyright and Other Restrictions

  79. The Program is owned by Atlant Software and is protected by the United States
  80. copyright laws and international treaty provisions. Atlant Software retains
  81. all rights not expressly granted. None of the components of the Program
  82. (including the documentation) may be copied, removed or altered, in whole or
  83. part, for any unauthorized use.

  85. Disclaimer of Warranty
  86. Atlant Software DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED,
  87. INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS
  88. FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE PROGRAM. THE END-USER ASSUMES
  89. ALL RISK AS TO THE SUITABILI TY, QUALITY, AND PERFORMANCE OF THE PROGRAM. IN
  90. NO EVENT WILL CRITICAL MASS, OR ITS DIRECTORS, OFFICERS, EMPLOYEES OR
  91. AFFILIATES, BE LIABLE TO THE END-USER FOR ANY CONSEQUENTIAL, INCIDENTAL,
  92. INDIRECT, SPECIAL OR EXEMPLARY DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS
  93. PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA OR BUSINESS INFORMATION, AND THE
  94. LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE PROGRAM OR
  95. ACCOMPANYING WRITTEN MATERIALS, EVEN IF Atlant Software HAS BEEN ADVISED OF
  96. THE POSSIBILITY OF SUCH DAMAGES.

  98. Atlant Software's LIABILITY TO THE END-USER (IF ANY) FOR ACTUAL DIRECT
  99. DAMAGES FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION,
  100. WILL BE LIMITED TO, AND IN NO EVENT SHALL EXCEED, THE AMOUNT ORIGINALLY PAID
  101. TO Atlant Software OR THEIR AGENTS FOR THE LICENSE OF THE SOFTWARE.

  103. Atlant Software does not warrant that the Program will satisfy the
  104. requirements of your computer system, or that the Program or its documentation
  105. are without defect or error, or that the operation of the Program will be
  106. uninterrupted.

  108. No Atlant Software distributor, dealer, agent, or employe is authorized to
  109. make any warranty for the Program.
  110.  
  111. U.S. Government Restricted Rights The Program and all accompanying written
  112. materials are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure
  113. by the Government is subject to restrictions as set forth in Restricted Rights
  114. in Technical Data and Computer Software Clause at FAR 52.227-7013(c)(1)(ii) or
  115. FAR 52.227-19.

  118. This Agreement constitutes the entire Agreement between you and Critical Mass.
  119. It is governed by the laws of the State of New York, United States.
